Terms of service

These terms of service set out the agreement between you and AIKontent for your access to and use of our software platform and website at aikontent.ai. By creating an account or using our platform, you agree to these terms. If you do not agree to these terms, you must stop using our platform immediately.

1. The service

AIKontent is an AI content creation platform operated as a software as a service. The platform helps marketers, agencies and founders plan content, generate drafts, edit copy in one workspace and publish blog posts, landing page copy, social posts and emails in your brand voice. We provide software tools to generate drafts from your briefs and topics, but we do not provide agency services, copyediting or manual drafting.

2. Accounts

You must create an account to use AIKontent. When you create an account, you must provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials, including your login details and passwords. You are responsible for all activity that occurs under your account. You must notify us at hello@aikontent.ai right away if you suspect or discover any unauthorized access to your account or any other breach of security.

3. Free 7-day trial

We offer a free 7-day trial for new accounts so you can test our platform. No credit card is needed to request a trial. During the 7-day trial period, you receive access to platform features to test content planning and draft generation. Trial accounts are limited to one per user or organization. We reserve the right to modify, restrict or cancel trial access if we suspect abuse or duplicate account creation.

4. Plans and billing

After your 7-day trial ends, continued access to AIKontent requires an active paid plan. We offer two subscription options: Starter at $29 per month and Pro at $79 per month. All subscriptions are billed monthly in advance using the payment method you provide.

You can cancel your subscription at any time through your account settings or by contacting us at hello@aikontent.ai. When you cancel, your subscription remains active until the end of your current monthly billing period. We do not provide refunds or credits for partial months, unused periods or unused features during a billing cycle. We may update our prices from time to time, but we will notify you before any price changes take effect for your account.

5. Acceptable use

You must use AIKontent only for lawful purposes and in accordance with these terms. You agree not to use the platform to generate, store, upload or distribute:

• Illegal, abusive, defamatory, harassing, obscene or hateful content.
• False, deceptive or misleading marketing copy or spam.
• Content that infringes or violates any copyright, trademark, trade secret, patent or other intellectual property or privacy right of any person or entity.
• Malicious code, viruses or software intended to interrupt or harm any system or data.

You also agree not to reverse engineer, decompile, copy, scrape or modify any portion of the AIKontent platform or infrastructure, nor attempt to gain unauthorized access to our servers, networks or database systems.

6. Customer content

You retain full ownership of all materials, prompts, briefs, instructions and inputs that you upload or submit to AIKontent. You also own the generated content, drafts and text outputs produced by the platform from your inputs.

By submitting inputs, you grant AIKontent a limited, non-exclusive license to process, display and store your inputs and outputs solely to provide, support and maintain the platform for you. We do not sell your content or use your proprietary brand inputs to train public models for third parties. You are solely responsible for ensuring that your inputs do not violate third-party rights or applicable laws.

7. AI output can be wrong and must be reviewed

AIKontent generates automated text drafts using artificial intelligence algorithms. AI output can be inaccurate, incomplete, misleading or factually incorrect. Outputs do not reflect the opinions of AIKontent or its founder Alex Morgan.

You are responsible for reviewing, checking, editing and verifying all drafts and outputs before publishing, distributing or using them in any marketing material, website, email or external channel. AIKontent is not responsible for any errors, factual inaccuracies, legal issues, brand damage or published mistakes resulting from unreviewed AI outputs.

8. Availability

We aim to keep AIKontent accessible and operating reliably, but we do not promise uninterrupted or error-free operation. We may suspend or restrict access to the platform periodically for maintenance, updates, system upgrades, security patches or technical fixes. We will try to schedule maintenance during low-traffic periods when reasonable. We are not liable for any losses, missed deadlines or business disruptions caused by temporary platform downtime or service interruptions.

9. Termination

You may stop using AIKontent and cancel your account at any time. We reserve the right to suspend or terminate your account and access to the platform immediately, without prior notice or liability, if you violate these terms, fail to pay subscription fees when due, engage in fraudulent activity or use the service in a way that harms AIKontent or other users. Upon termination, your right to access the platform stops right away.

10. Disclaimers and limitation of liability

AIKontent is provided on an as-is and as-available basis, without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

AIKontent, its founder Alex Morgan and its affiliates are not liable for any indirect, incidental, consequential, special or punitive damages, including loss of profits, lost revenue, lost data or business interruption arising from your use of or inability to use the platform. Our total liability for any claim arising under these terms or related to the service is limited to the total amount paid by you to AIKontent in the 12 months before the event giving rise to the claim.

11. Changes to the terms

We may update or revise these terms from time to time to reflect changes in our platform, legal requirements or business operations. When we post changes, we will update the date at the top of this page. If we make material changes, we will notify registered account holders by email or through a notice within the platform. Continued use of AIKontent after updated terms take effect constitutes your acceptance of the new terms.

12. Contact

These terms are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to conflict of law rules. Any legal disputes arising from these terms or your use of AIKontent must be resolved in the state or federal courts located in Austin, Texas.
